Environmental Site Assessments
Eagle has full-service capabilities in the performance of Phase I and II Environmental Site Assessments (ESAs); Wetlands Determinations, Delineations and Permitting; and National Environmental Policy Act (NEPA) Compliance Assessments.
A Phase I ESA is performed to satisfy the “all appropriate inquiry” into the past ownership, development, and uses of a property required under for the innocent land owners defense under the Comprehensive Environmental Response Compensation and Liability Act (CERCLA). Eagle performs individual Phase I ESAs in accordance with the American Society for Testing Materials (ASTM) Standard E-1527-05. The purpose of the Phase I ESA is to identify any and all Recognized Environmental Conditions (RECs) associated with the property. A REC is the presence or likely presence of any hazardous substance or products on the property or adjoining property that indicate a present of past release of hazardous material into property structures or soil or groundwater media. The four components of a Phase I ESA include:
- Records Review - Records review of historical development of the site including a review of historical topographic maps, aerial photographs, Sanborn Fire Insurance Maps, City Directories, regulatory agency records specified in the AST Standard E-1527-05, chain of title records, and soils and geology bulletins for the area
- Site reconnaissance - Site reconnaissance includes a site visit to identify structures, site development, drainage patterns, observations of stressed vegetation, current and prior use of the property and adjacent properties, and any other condition(s) that might reveal a potential REC
- Interviews - Interviews are conducted with the current and past property owners and other individuals familiar with current and past operation of the property
- Reporting – A comprehensive report is prepared that documents all regulatory and historical records that were reviewed, interview records, and site reconnaissance observations. RECs are described and recommendations for further investigation are provided.
A Phase II ESA is conducted to evaluate any RECs that may have been identified during the performance of Phase I ESA. As with the Phase I ESA, the Phase II is performed with the level of care required to satisfy the innocent land owner’s defense under CERCLA. The Phase II ESA typically includes a soil and/or groundwater investigation to determine whether a REC or RECs have impacted shallow soil or groundwater media. In formulating the scope of work for the Phase II ESA, Eagle professionals carefully evaluate the data quality objectives for the Phase II ESA and data evaluation under State Corrective Action and Risk Assessment Programs (For example, RECAP in Louisiana, TRRP in Texas). If groundwater and/or soil media are found to be impacted, Eagle professional geologists and engineers can assist our clients with follow-up risk assessment and corrective action under these programs.
In conjunction with our Property Transactions projects associated with ESAs, Eagle has conductred numerous Wetlands Determinations and Delinations for our clients. Wetland Determinationa and Delineations requires extensive experience and working knowledge of wetland vegetation, hydric soils, and wetland hydrology. Field experience is critical to ensure that the most accurate and appropriate wetlands boundary are established. Eagle has conducted wetland determinations and delineations in a variety of wetland habitat types. We reliy on the latest scientific techniques and approaches to provide our clients with the best methodologies possible. In many projects, this is conducted with Global Positioning System (GPS) equipment with sub-meter accuracy.
Eagle’s staff of environmental professionals has experience in conducting National Environmental Policy Act (NEPA) documents. NEPA documents are required for all projects on federal land and federally-funded projects, including Coastal Wetlands Planning, Protection, and Restoration Act (CWPPRA) projects.
Eagle can assist our clients with NEPA documents, including Environmental Assessments (EA) and Environmental Impact Statements (EIS).
